Can You Use a Section 125 Plan with an ICHRA or HSA Plan?

Many employers already have a health benefit in place: a traditional group plan, an ICHRA (Individual Coverage HRA), or a high-deductible plan paired with an HSA. A common question is whether a Section 125 program can sit alongside it.

The short answer is yes. Our program is a supplemental product, so it works alongside any insurance offering. It does not replace your health plan.

Why It Works Alongside Your Health Plan

The program pairs a Section 125 cafeteria plan with fully insured, fixed-indemnity insurance. Fixed-indemnity coverage is a limited benefit that supplements comprehensive health insurance. It is not major medical coverage, so it does not compete with your current plan. Your existing health plan stays exactly as it is.

Section 125 with an ICHRA

With an ICHRA, employees buy their own individual health insurance and the employer reimburses them. Our program adds supplemental benefits on top of that, such as unlimited virtual care, $0-copay generic prescriptions and hospital indemnity cash benefits, and it lowers payroll taxes on the pre-tax dollars employees use for those benefits.

Section 125 with an HSA-Qualified Plan

The program also works alongside HSA-qualified high-deductible plans in almost every case. There is one thing to check: some HSA plans do not allow pairing with other health products, because certain benefits can affect HSA eligibility. This is rare — we have seen it only once or twice — and we check your plan’s rules during setup, before anything goes live.

What About ACA Requirements?

The fixed-indemnity policy is not minimum essential coverage (MEC) under the ACA. If you need MEC, a separate MEC policy can be added on request. Most employers do not need it, because they already have health insurance in place. We help every employer stay compliant with the ACA. See compliance for details.
